Payment terms: Full payment is required upon signing if four (4) blasts or less are purchased. Orders of five to twelve (5-12) e-mails will be billed monthly until complete. Orders of 12 e-mails or greater will be divided by twelve (12) and billed monthly for twelve (12) months. Invoices are due and payable upon receipt, and are considered past due after 30 days. Eight Legged Media reserves the right to cancel agreements for non-payment. Interest shall accrue on any unpaid balance at the highest lawful rate.
Advertiser shall be liable for attorney’s fees and costs on accounts sent out for collection. The laws of Illinois shall govern this agreement. Service interruption/Limits of Liability: Advertiser agrees to not hold Eight Legged Media responsible for any liability loss, cost, claim, damage, or causes of action of any kind that it may suffer as a result of transactions contracted herein, including but not limited to loss resulting from service delays and incomplete or interrupted service, regardless of cause or fault. Eight Legged Media’s liability is limited to extension of contract by period of time ad failed to display.
Cancellation: Any advertising canceled shall be subject to a 50% contract cancellation fee on the remaining balance of the contract. Advertiser agrees that such a cancellation shall cause Eight Legged Media to incur damages and the foregoing cancellation fee(s) is reasonable compensation to Eight Legged Media for such damages. Credits: Any advertising error made by Eight Legged Media or its employees shall be settled as a make good credit on a future advertisment. Under no circumstances shall advertiser be entitled to a refund.
Art Submission: Art, submitted in a different format or art that must be changed, due to format, sizing etc. will incur a fee. Art fees are $75/hr. with a minimum of twenty minutes. All art fees will be mutually agreed on unless the charge is $25 or less in which case it will be billed directly.
Term/Renewal. The initial term of this contact shall be for the term stated in the notes section of this contract (the “Initial Term”) commencing on the date this contract is executed by authorized and returned. At the expiration of the Initial Term, this contract will automatically renew for successive terms (as stated in the notes section of this agreement) (each a “Renewal Term” and collectively with the Initial Term the “Term”) unless a party provides the other parties with notice of its intent not to renew this contract at least thirty (30) days prior to the expiration of the then current term. I have read and agree to the Terms and Conditions as stated above. I am authorized to make financial and contractual commitments on behalf of advertiser. This represents the entire advertising agreement between Eight Legged Media and the advertiser and supersedes all prior negotiations representations or agreements, whether written or verbal.
